Cleva Technologies Inc, (“Cleva”, “we”, “us”, “our”) is a technology platform that enables users to operate a USD wallet, convert and transfer USD to their local currency account, and use a dollar card for online purchases (collectively, "Services"). To encourage the continued use of our platform and reward loyalty, we are introducing the Cleva Loyalty Points ("Cleva Points").
This Cleva Points Policy ("Policy") governs your participation in the Cleva Points Program. It outlines the terms, conditions, and processes related to the accumulation, eligibility, redemption, and management of Cleva Points.
By participating in the Cleva Points Program, you agree to be bound by this Policy. We encourage you to read it to understand your rights and obligations. By accessing the platform and clicking 'I Agree,' you confirm that you have reviewed this Policy and accept its terms and conditions.
We may make changes to this Policy from time to time and when we do, we may notify you through your registered email address on the Platform of the revisions made to this Policy. However, you understand that this may not always be practicable and when that occurs, you agree to waive your right to notification.
It is your responsibility to review this Policy frequently and to stay informed of all changes which may be made to it. By using our services after a revision has been made to this Policy, you consent to be bound by the changes we made.
The following words shall have the meaning assigned to them in this Policy:
Cash Redemption: The process by which Customers convert their Points into USD which is then deposited into their Cleva wallet on the platform.
Cleva Points: A virtual loyalty reward unit earned by Customers after completing qualifying transactions, as outlined in this Policy. Once earned, Cleva Points can be redeemed for cash, in accordance with the terms and conditions in this Policy.
Cooling Period: The period following a Qualifying Transaction during which earned points remain in a pending state before becoming available for redemption.
Customer(s): Any existing user of our Services who meets the eligibility criteria for earning and redeeming Cleva Points under the Program.
Fraudulent Activities: Any actions that violate Cleva’s policies, including but not limited to unauthorized transactions, abuse or misuse of Cleva Points, or any attempts to manipulate the program for personal benefit. This also includes transactions flagged by Cleva, Cleva’s partners, or other monitoring systems as suspicious or fraudulent. Fraudulent activities may involve actions such as falsifying transaction information, exploiting loopholes within the system.
Negative Points means Points that are recorded against a customer’s points balance due to certain activities on the customers account such as refunds, chargebacks, fraudulent transactions and other activities as Cleva may from time to time decide.
Platform: The digital interface, including Cleva’s website and mobile application, through which Customers access and use the Services.
Program: The Cleva Loyalty Points Program, through which eligible Customers can earn and redeem Points in accordance with the terms of this Policy.
Qualifying Transaction: Deposits and Payouts of at least $10 or such other eligible activities as determined by Cleva. Transactions that are pending, reversed, refunded, disputed, or found to be fraudulent do not qualify for Points.
Services:The wallet, card, and multicurrency payout services provided by Cleva to its Customers
USD Wallet: A digital wallet provided by Cleva and linked to a customer's Cleva account, where funds are held in U.S. Dollars (USD).
To participate in the Cleva Loyalty Points Program, you must meet the following criteria:
Active and Verified Account: You must be a registered, active, and verified user of our platform.
Good Standing: Accounts that are suspended, delinquent, or involved in fraudulent activity are not eligible to participate in the Program and cannot earn or redeem Points.
Policy Compliance: If your Points have been revoked or withheld due to violations of this Policy or any other Cleva policies, you will no longer be eligible to accumulate or redeem Points in the future.
Points are awarded to Customers based on the successful completion of specific Qualifying Transactions as may be specified on the platform from time to time.
The Point structure is designed in a way that Points are awarded for activities performed on the platform and credited to your Cleva Points account.
The conversion rate from Points to local currency will be displayed at the time of redeeming the Points and this may change from time to time at Cleva’s discretion. Points will not be awarded retroactively for past transactions.
Points earned by you (if eligible) can only be redeemed for cash, subject to meeting the redemption requirements and compliance with our platform's terms and conditions.
You may choose to convert your accumulated Points into cash. The redeemed cash will be deposited directly into your USD wallet on the platform and can be transferred to your local currency account when you initiate a payout.
To be eligible for cash redemption, you must have accumulated a minimum of 50 Points. The minimum threshold for redemption is subject to change at our sole discretion.
To redeem Points for cash, you must complete the following steps:
Points cannot be transferred, exchanged, or sold to other Customers under any circumstances.
Redemption of Points may be subject to additional verification procedures, including Know Your Customer (KYC) checks and compliance with applicable anti-money laundering (AML) regulations.
We reserve the right to impose limits on the number of Points that may be redeemed within a specified period.
We reserve the right to withhold, redact, or deduct Points from your accounts under the following circumstances:
Qualifying Transaction: Deposits and Payouts of at least $10 or such other eligible activities as determined by Cleva. Transactions that are pending, reversed, refunded, disputed, or found to be fraudulent do not qualify for Points.
If a transaction linked to redeemed Points fails (e.g., an unsuccessful transfer, refund, chargeback), the redeemed Points will be deducted and recorded as a negative point against the Customer’s account.
In cases where Points are withheld, redacted, or subject to a negative balance, you will not be entitled to cash compensation for lost or forfeited Points.
We reserve the right to suspend or terminate your participation in the Program at any time for the following reasons:
If your account is suspended, any accumulated Points may be withheld or forfeited.
If your account is terminated for any reason (including violation of terms of service or fraud), all Points accumulated will be forfeited, and no further Points can be redeemed.
We reserve the right to modify, suspend, or discontinue the Loyalty Points Program at any time, with or without notice to customers. Changes to the Program may include adjustments to how Points are earned, redeemed, or the introduction of new rewards or restrictions.
Customers must comply with all applicable laws and regulations and must not engage in any fraudulent, deceptive, or abusive practices. As participants in the financial services industry, we uphold stringent measures to prevent the misuse of our services for fraudulent purposes such as money laundering, terrorism financing, proliferation financing, and other unlawful activities.
We will carry out comprehensive Customer Due Diligence (CDD) procedures to ensure compliance with Anti-Money Laundering (AML) and Countering Financing Terrorism (CFT) laws and regulations.
Additionally, we retain transaction records as required by law and to support law enforcement agencies during investigations where required.
We will not be liable for any damages, losses, or expenses arising out of or related to the Loyalty Points Program, including but not limited to the inability to redeem redeemable points or any technical issues related to the point.
You agree to indemnify and to hold us harmless from and against any misuse or illegal use of the Cleva Points Program by Employees, Contractors, Beneficial Owners of your company or any third parties who gain access to the link through any carelessness, negligence or inadvertence of yours.
You are solely responsible for any taxes, fees, or charges that may apply to the Points you earn or redeem, including any applicable sales or income taxes. You agree to comply with all tax obligations that may arise from your participation in the Loyalty Points Program. Cleva may however, at its discretion, withhold or deduct any applicable taxes from Points or cash rewards redeemed under the Program, where required by applicable law.
This policy shall be governed and construed in accordance with the laws of the State of Delaware, United States.
Cleva reserves the right to review and update this Policy periodically to ensure its relevance, compliance with applicable laws, and alignment with business objectives. Customers are encouraged to review the policy regularly to stay informed of any changes.
Continued participation in the Cleva Points Program following any updates constitutes acceptance of the revised Policy. If a customer does not agree with the updated policy, they may opt out of the program by contacting Cleva’s customer support.
